Wag & Bone Terms of Use & Services Agreement

This agreement governs the use of Wag & Bone facilities and services. Please review carefully before participation.

Waiver and Release of Liability

This Agreement is entered into by and between Wag & Bone, LLC (“Wag & Bone”) and the individual creating an account or using services (“Owner”).

By creating an account, accessing the facility, or using any Wag & Bone service, Owner acknowledges that they have read, understood, and agreed to the terms below.

1. Scope of Services

Wag & Bone is a multi-service facility that may include, without limitation:

Indoor Dog Park and Bar Lounge
Daycare
Boarding
Grooming and Self Wash
Private Events, Meetups, and Space Rentals.

This Agreement applies to all services and use of the facility, whether used individually or in combination.

2. Acknowledgment and Assumption of Risk

Owner understands that Wag & Bone is an environment where dogs and people interact in both supervised and off-leash settings.

Owner acknowledges that participation involves inherent and unavoidable risks, including but not limited to:

Dog bites, scratches, or other injuries
Dog-to-dog interactions, fights, or altercations
Dog-to-human interactions
Slips, falls, or collisions within the facility
Exposure to illness or communicable conditions
Unpredictable behavior of dogs or people

Owner further understands that dogs are inherently unpredictable and may react unexpectedly, even in controlled environments.

Owner knowingly and voluntarily assumes all risks, including those that may arise from the negligence of Wag & Bone, its staff, or other guests.

3. No Guarantee of Safety / No Reliance

Owner acknowledges that Wag & Bone does not guarantee a risk-free environment.

While Wag & Bone takes reasonable measures to promote safety, Owner agrees that:

Incidents may still occur
Wag & Bone does not guarantee prevention of injuries, illness, or damages
Owner is not relying on any representation, statement, or expectation that the environment is completely safe

4. Liability Waiver and Release

To the fullest extent permitted by law, Owner:

Releases Wag & Bone and its owners, members, employees, and affiliates from any liability for injury, illness, damage, loss, or death involving:

– Owner
– Owner’s dog(s)
– Owner’s guests
– Any third parties

Agrees not to bring claims against Wag & Bone arising out of or related to use of the facility or services, including claims arising from negligence
Agrees to indemnify, defend, and hold harmless Wag & Bone from any claims, damages, losses, or expenses (including legal fees) arising from:

– Owner’s dog(s)
– Owner’s actions
– Owner’s guests

5. Responsibility for Dog(s)

Owner represents that their dog(s):

Are in good health
Have not shown aggressive or dangerous behavior
Are suitable for a group or public environment

Owner agrees that they are fully responsible for:

Their dog’s behavior at all times
Any injury or damage caused by their dog
Removing their dog if behavior becomes unsafe or disruptive

6. Responsibility for Guests

Owner assumes full responsibility for all guests they bring or invite to Wag & Bone, including during private events.
Owner agrees that:

Guests must comply with all Wag & Bone policies
Owner is liable for any damages, injuries, or incidents caused by their guests
Wag & Bone is not responsible for supervising individual guests

7. Indoor Dog Park and Off-Leash Areas

Owner understands that certain areas operate as off-leash environments where dogs may interact freely.

Owner acknowledges that:

Dogs may engage in physical play or conflict
Staff provide general supervision only and do not guarantee the prevention of incidents
Wag & Bone is not responsible for the actions of other dogs or guests

Owner remains fully responsible for their dog(s) at all times.

8. Events and Private Use

For private events, meetups, or space rentals:

Wag & Bone provides access to space and general operational support
Wag & Bone does not assume responsibility for individual guest supervision, dog behavior, or interactions

The event host (Owner) is fully responsible for:

All guests and dogs attending
Ensuring compliance with all policies
Any damages, injuries, or incidents occurring during the event

9. Alcohol and Conduct Policy

Wag & Bone operates a bar/lounge environment.

Owner and guests acknowledge that:

Alcohol consumption is voluntary and at their own risk
Wag & Bone is not responsible for monitoring individual consumption levels
Wag & Bone is not liable for any injuries, damages, or incidents resulting from intoxication

All guests must behave responsibly.

Wag & Bone reserves the right to refuse service, remove individuals, or terminate participation due to unsafe, disruptive, or inappropriate behavior.

10. Dog Health and Requirements

Owner represents that their dog(s):

Are current on required vaccinations as applicable to the service use
Do not have communicable conditions
Are flea and tick free
Owner understands that illness may still occur despite precautions and agrees not to hold Wag & Bone responsible for such occurrences.

11. Veterinary Care Authorization

Owner authorizes Wag & Bone to obtain medical care if a dog appears ill, injured, or in distress.

Owner agrees to:

Be fully responsible for all veterinary and transportation costs
Allow Wag & Bone to use a preferred or emergency veterinary provider

12. Damage and Personal Property

Owner agrees to be financially responsible for:

Any damage caused by their dog(s) or guests
Any harm to Wag & Bone property, staff, or other individuals

Wag & Bone is not responsible for lost, stolen, or damaged personal belongings.

13. Payments, Packages, and Credits

All services are subject to applicable pricing and taxes as determined by Wag & Bone.
Prepaid packages, memberships, subscriptions, and service credits are non-refundable, unless otherwise explicitly stated.
All packages, memberships, subscriptions, and credits are valid only for a defined period of time, as specified at the time of purchase.
Unused services, sessions, or credits will expire at the end of their validity period and will not roll over, accumulate, or be extended, unless otherwise expressly approved by Wag & Bone in writing.
Expired packages, memberships, subscriptions, or credits have no remaining value and cannot be redeemed, transferred, or reinstated.
Packages, memberships, subscriptions, and credits are non-transferable and may only be used by the account holder and their registered dog(s), unless otherwise approved.
Cancellation and no-show policies apply as communicated at the time of booking and may result in loss of session or credit.

14. Photo and Media Release

The owner grants Wag & Bone permission to use photos or videos taken within the facility for marketing and promotional purposes, without compensation.

15. Right of Refusal

Wag & Bone reserves the right to:

Refuse service
Remove any dog or individual
Modify participation at its sole discretion

16. Policy Changes

Wag & Bone may update policies at any time. Continued use of services constitutes acceptance of updates.

17. Legal Terms

This Agreement is governed by the laws of the State of New York
Any disputes shall be handled in New York
Owner waives the right to a jury trial
If any provision is found unenforceable, the remaining provisions remain valid

18. Acknowledgment

By creating an account or using Wag & Bone services, Owner confirms that they:

Have read and understood this Agreement
Agree to all terms voluntarily
Assume all associated risks for themselves, their dog(s), and their guests
